Appeal for Urgent Solidarity Action for the
Adamson University Faculty and Employees Association
The Adamson University Faculty and Employees Association (AUFEA) held a strike vote last December 11 with the following results: Yes – 291, No – 83, Stray – 14. The grounds of the strike is “gross unfair labor practice” and “union busting” as union president Professor Orestes delos Reyes was served a notice of dismissal on October 24 for alleged “gross misconduct, unprofessional behavior”. The illegal termination/union busting case is now ongoing before the National Conciliation and Mediation Board (NCMB).
With due respect to NCMB Conciliator-Mediator Michelle Jean O. Renido, who is hearing the case, the BMP believes that the primary motive for the heavy-handed punishment to Prof. delos Reyes is “union busting”, a gross unfair labor practice and “strike-able issue”.
The complaint against the AUFEA union president is fabricated. The complainant-student did not specifically see Prof. delos Reyes allegedly curse her with “anak ng puta”. She is not even his student. Requirements for procedural due process were also not achieved. The verdict was reached in a single session without giving Prof. delos Reyes an ample chance to defend himself.
Also, the punishment, dismissal (with a costly paid advertisement in the Philippine Daily Inquirer, Second Front Page, October 30, 2014), is not commensurate to the allegations, even if it were true. In previous cases of “sexual harassment” handled by the union through its grievance procedure, erring employees were only served work suspensions.
The BMP is, therefore, compelled to ask: “what is the reason behind the swift and severe punishment against Prof. delos Reyes?” We believe that the University Administration seeks to decapitate the Union (Adamson University Faculty and Employees Association – AUFEA) in preparation for collective bargaining negotiations in 2015.
Hence, the BMP is calling on all labor unions – regardless of ideological/political persuasions and organizational affiliations – to support the AUFEA and their pending strike at said university.
We likewise appeal to the University Administration – in the spirit of social justice, peace and love campaigned for by Pope Francis – to practice restraint and fairness in the exercise of “management prerogative”. We also seek the intervention of Church leaders, particularly the Catholic Bishops Conference of the Philippines (CBCP), to prevent the escalation of infringements to labor rights and welfare in Adamson University.
