Kaliwa dam: bangungot ng kaunlaran

Pinipilit ipatanggap sa atin ang Kaliwa Dam. Ginagamit na dahilan ang diumanoý krisis sa tubig sa Kamaynilaan. Sa biglang tingin, parang okay naman. Pero kapag sinuring mabuti ang proyekto, lilitaw ang maraming katanungan na senyales ng nakatagong malaking problema at kapahamakan.

Dumaan ba sa tamang proseso ang proyekto? Mahalagang suriin kung dumaan sa tamang proseso ang anumang proyekto dahil ito ang hakbang para magarantiyang ligtas ito at magsisilbi sa kapakanan ng mamamayan. Sa kaso ng Kaliwa Dam, mapagpasya ang mulat at malayang pagsang-ayon ng mga kapatid nating Katutubong Dumagat-Remontados, gayundin ang pagsang-ayon ng lahat ng LGU na apektado nito gaya ng mga bayan ng Infanta, Real at Nakar. Gayunman, ang konsultasyong isinagawa ng MWSS sa mga Katutubong Dumagat-Remontados noong Disyembre 2019 ay batbat ng kontrobersiya. Gayundin sa pamamagitan ng Board Resolution, ang bayan ng Infanta ay nananatiling tutol sa Kaliwa Dam. Gayunman sa kabila ng mga problemang ito, agresibo ang MWSS na maitayo ang Kaliwa Dam. Sa katunayan, kahit sa gitna ng pandemya kung saan limitado ang mobilidad natin sa sarili nating bayan dahil sa community quarantine ay malayang nakakalabas-pasok sa Kaliwa Dam site ang mga Intsik at nagtutuluy-tuloy ang DPWH sa konstruksyon ng access road sa Kaliwa Dam kahit sa alituntunin ng IATF ay tigil muna ang mga gawaing konstruksyon. Ngayon, halos patapos na ang access road.

Ligtas at epesyente ba ang impra-istruktura ng Kaliwa Dam? Una, ang contractor ng proyekto ay ang China Energy Engineering Co. (CEEC) Ltd. na ayon mismo sa Commission on Audit (COA) ay hindi nakapagsumite sa MWSS ng kumpletong rekisitos sa tamang panahon. Ang kompanyang ito rin ay na-ban ng World Bank noong 2019 sa kasong pamemeke ng mga credentials sa proyekto nila sa Republika ng Zambia. Maging ang dam na ginawa nito sa bansang Ecuador ay pinatigil din dahil sa nakitang 2 libong crack nito na maaaring maging sanhi ng pagbulas gaya ng nangyari sa isang dam sa bansang Brazil. Ikalawa ang lokasyon at disenyo ng itatayong Kaliwa Dam ay mapanganib. Ayon sa mga eksperto ang lokasyon ng pagtatayuan ng dam ay malapit sa faultline, kung kaya delikado ito sa mga paglindol. Ang sukat at taas ng dam ay lubhang malaki at mataas na maglulubog sa ilang bayan at komunidad kahit wala pang kalamidad, at papatay sa mga ilog na magdudulot ng pagkawala ng pangisdaan at tagtuyot sa mga sakahan. Ang laki ng dam ay sapat para maulit ng higit na mas matinding trahedyang inabot natin noong bagyong Winnie kung ito ay umapaw , lalo na kung ito’y mabulas.

May krisis nga ba sa tubig sa kamaynilaan? Ayon sa mga eksperto, kung tubig-inumin lamang, sapat ang kasalukuyang suplay na tubig sa Kamaynilaan. Ngunit kung ito’y para sa lumalaking demand ng urbanisasyon na kinatatangian ng malalaking mga malls, subdibisyon kung saan halos lahat ng bahay ay may swimming pool at nagpaparamihan ng mga kotse at sasakyan, at mga naglalakihang hotel at restaurant, kakapusin nga ang Angat Dam. Malinaw kung gayon na ang Kaliwa Dam ay hindi para sa tubig ng mamamayan kundi para sa layaw at tubo ng iilang mayayamang negosyante’t kapitalista. Sila ang makikinabang, tayo naman ang mapapahamak.

Malinaw kung gayon na hindi kaunlaran ang hatid sa atin ng Kaliwa Dam kundi pasakit at kapahamakan. Wawasakin nito ang kalikasan; palalayasin nito ang mga katutubo sa kanilang lupang ninuno; pagkakaitan nito ng mayamang tubig-ilog mula sa Agos River ang mga lupaing agrikultural at tatanggalan din ng pagkukunan ng pagkain ang mamamayang nakaasa dito; at higit sa lahat, isusuong tayo nito sa matinding panganib.

Ang Sierra Madre ay kabuhayan at pananggalang natin. Ang pagkawasak nito ay nangangahulugan din ng pagkawasak ng ating kabuhayan at kaligtasan. Sisirain ng Kaliwa Dam ang Sierra Madre. Ito pa lamang ay matibay ng dahilan para tutulan natin ito. Hindi natin kailangan ang Kaliwa Dam. Ang kailangan natin ay malusog na Sierra Madre. Wag tayong magpalinlang o maglaway sa panandaliang pakinabang na ilang milyong pisong Royalty Fee dahil ang katumbas naman nito ay ang ating kaligtasan at kabuhayan.

[Statement] Pahayag ng Pagkundena sa Patuloy na Karahasan ng Militar sa mga Katutubong Dumagat-Remontado -STOP Kaliwa Dam Network

Habang ang karamihan ay nakatuon sa isyu ng COVID-19, ang pwersa ng estado sa kabilang banda ay patuloy naman ang pananakot at pangdadahas sa mga Katutubo ng Quezon at Rizal dahil sa Kaliwa Dam.

Matapos ang pananakot sa mga katutubong Dumagat-Remontadong papunta sa isang pagdiriwang ng anibersaryo ng People Power Revolution noong Pebrero 24, may mga pahayag mula sa parehong komunidad na isang kapwa nila katutubo ang dinakip ng yunit ng militar sa General Nakar noong ika-1 ng Marso. Napag-alaman ding binugbog ang nasabing katutubo habang nasa kustodiya ng nasabing elemento ng militar. May mga nakasaksi sa nasabing pagdukot at mga litrato ng binugbog na katutubo.

Mariing kinukundena ng STOP Kaliwa Dam Network ang patuloy na karahasan ng militar sa nasabing katutubong komunidad. Aming kinukundena ang ‘di-makatuwirang paggamit ng dahas, walang basehang pananakot, at panggigipit na ginagawa ng mga puwersang militar.

Gamit ang katuwirang paglaban sa armadong sigalot sa kanilang lugar, naiipit ang mga katutubo sa kabila ng kawalan ng patunay na sangkot sila sa ibinibintang sa kanila. Lumilikha ng klima ng takot ang karahasan ng militar at matinding ginagambala ang kabuhayan at payapang pamumuhay ng mga katutubo sa kanilang mga lupain.

Ang panawagan namin ay kapayapaan. Iginigiit namin sa militar sa nasabing lugar na maging mga tagapagpatupad ng batas at kaayusan, hindi pasimuno ng panggigipit at pang-aabuso. Ang pangunahing tungkulin ng hukbong sandatahan ay pangalagaan ang teritoryo ng bansa at depensahan ang mga mamamayan nito, hindi supilin ang kanilang karapatan, lalo na ang karapatan tumutol sa mapanirang Kaliwa Dam. Karapat-dapat lamang suportahan, hindi dahasin, ang mga katutubo sa kanilang pag-aalaga sa kanilang lupaing ninuno, na buhay at nagbibigay buhay, na hiram lamang sa salinglahi, at bilang paglilingkod sa sambayanan.

Itigil ang karahasan sa mga katutubo!

[Press Release] Dumagat Leaders Response to President Duterte’s statement on using force to construct Kaliwa Dam -Lilak

“Sisirain ng dam ang aming mga buhay. Sa aming lupain kami kumukuha ng aming makakain. Ito ang aming kabuhayan. Ang kanilang sapilitang pag-angkin sa aming mga lupain ay kanila na ring pag-angkin sa aming mga buhay [It will destroy our lives. Our land is where we get our food. It is our livelihood. They are not only taking our lands, they are also taking our lives,” according to the speaker for AGTA, a Dumagat organization based in General Nakar.

This is in response to the statement made by President Duterte on Monday that he will not hesitate to use force to construct the Kaliwa Dam, a Php 18.7 Billion project that will be loaned from China. According to Duterte, he will use the “extraordinary powers” of the presidency, citing “outright police power” to continue construction of the mega dam.

“Kaming mga katutubo ay may lehitimong karapatan sa aming lupaing ninuno. Imbes na ang presidente at ang gobyerno ang mangalaga sa aming mga karapatan, sila pa mismo ang nangunguna sa paglabag ng mga ito [We have a right to our ancestral domains. Instead of protecting our rights, the president and the government are the first to violate them],” said Henry Borreo of the indigenous peoples organization, Pigtaanan ni Dumaget Remontado di General Nakar Quezon.

On October 22, the Department of Environment and Natural Resources (DENR) issued an Environment Compliance Certificate or ECC to the Kaliwa Dam project. This is despite the protests of indigenous peoples in Quezon and Rizal who will be uprooted from their ancestral lands.

The Dumagat and Remontado also fear that the Kaliwa Dam will worsen climate crisis in the Philippines.

“Ramdam na natin ang pagbabago ng panahon. Ang tag-ulan ay nagiging tag-init at ang tag-init ay nagiging tag-ulan. Kapag itinayo ang Kaliwa Dam at sinira ang libu-libong mga puno sa Sierra Madre, hindi lamang kaming mga katutubo ang maapektuhan, kung ‘di milyun-milyong mga Pilipino [We can already feel the effects of climate change. Seasons have been interchanging. If they construct the dam, they will kill thousands of trees in Sierra Madre, and this will affect not only us Dumagat and Remontado but millions and millions of Filipinos],” said Meleng Rutuqeio, kaksaan [captain] of AGTA.

During the interview on Monday, Duterte stated that violations on environment and indigenous rights are not enough reasons to stop the project. He stressed that his primary concern is the welfare of the people affected by water shortage. The Dumagat and Remontado, however, expressed their doubts that the construction of the Kaliwa Dam will benefit ordinary Filipinos.

“Maraming alternatibong paraan para maibsan ang krisis sa tubig sa Metro Manila. Imbes na mabaon tayo sa bilyun-bilyong utang sa Tsina para sa pagpapagawa ng Kaliwa Dam, bakit hindi natin ayusin ang mga dam katulad ng Wawa dam at ng Umiray dam [There are many alternatives that can alleviate water shortage in Metro Manila. Instead of loaning billions from China, why don’t the government turn their attention to existing dams like the Wawa dam and Umiray dam],” asked Borreo.

“Ang Kaliwa Dam ay hindi para sa mga mahihirap katulad namin. Ito ay para patabain ang mga bulsa ng mga negosyante [The Kaliwa Dam is not for the poor like us. Its purpose is to fatten the pockets of businessmen], Rutuqeio added.
The youth of Dumagat and Remontado also appeal to the president that the government treat them as humans.

“Kami ay tao rin. Hindi kami ibang lahi. Kami ay parte ng mga taong pinangakuan ng pagbabago ng pangulo. Nanawagan kami sa kanya bilang tao na ‘wag gumamit ng dahas. Sapagkat ang paggagamitan nýo ng dahas ay mga kababaihan at mga kabataan, mga matatanda at mga sanggol [We are humans. We are not a different race. We are a part of the people that the president made a promise with. We ask of him as a human being to not use force against us for they will harm women, elders, and children],” said a Dumagat youth leader.

[Statement] On World Indigenous People’s Day Defend the indigenous peoples against destructive mining and large dams -ATM

Quezon City – Alyansa Tigil Mina (ATM) supports the struggles of indigenous peoples all over the world. In their continuing journey to assert their right to self-determination and to defend their land, lives and culture, they have stood in front of destructive development projects and protect the forests, water and natural resources for everyone’s benefit.

Our alliance stands with the Ifugaos in Brgy. Didipio, Kasibu, Nueva Vizcaya, who are demanding the immediate cancellation of the mining contract of OceanGold Philippines, Inc. (OGPI). We echo their call that President Duterte must immediately order the closure of this open-pit mine and to direct the NCIP to consult the local indigenous communities and the local governments in the area. OGPI operations have abused the human rights of local communities, violated our environmental laws and failed to comply with its own contractual obligations under its expired mining contract.

ATM also supports the call of the Agta-Dumagat-Remontado tribes in Quezon and Rizal who are opposing the Kaliwa Dam project. This project will displace the indigenous communities, threaten the already endangered flaura and fauna in the Sierra Madre Mountain Range, and compromise the farms and food sources of thousands of families in the areas. We stand in solidarity with the demands of the Stop Kaliwa Dam coalition to the DENR to withhold the issuance of the ECC for the Kaliwa Dam. The NCIP must likewise ensure that meaningful and genuine processes of securing the free, prior and informed consent of the affected indigenous communities are implemented.

A petition was filed before the Supreme Court on Thursday to temporarily stop the implementation and eventually void the allegedly onerous irrigation project loan deal between the Philippines and China.

Members of the Makabayan bloc in the House of Representatives asked the high court to issue a temporary restraining order to halt the ₱3.69-billion Chico River Pump Irrigation Project, which has a loan component with a 2 percent interest rate. They said the project, which will begin construction in July, violates the Constitution.

The petitioners, led by Makabayan senatorial candidate Neri Colmenares, said the loan deal has a confidentiality clause “violative of the Constitution that provides for the right to information of the Filipino people on foreign loans contracted by the government.” They said the loan deal was approved after the fact by the Monetary Board, which does not conform to the law that requires prior concurrence.

The group said the loan agreement binds the Philippines to a Chinese arbitration tribunal, which will be officiated by Chinese arbitrators using Chinese laws.

Makabayan Chairman Neri Colmenares and several progressive groups asked the Supreme Court on Thursday to block a $62-million loan from China to fund the construction of the Chico River Dam.

The petitioners argued the deal was unconstitutional because it contained a confidentiality clause that violates the Filipino public’s right to information on foreign loans.

The agreement, they said, was also approved after-the-fact by the Monetary Board, which was against the requirement of prior concurrence under the law.

Under the deal, the project would also be awarded to a Chinese construction firm, thereby doing away with the country’s procurement laws and the Filipino First Policy, the petitioners said.

It also hauls the country to a Chinese arbitration tribunal, officiated by Chinese arbitrators using Chinese laws, in violation of the constitution, they said.

‘Kaliwa Dam project will destroy us, our homes’ —Dumagat tribe

Indigenous People’s (IP) group in Infanta, Quezon province and in Tanay, Rizal traveled to the city to air their grievances against the construction of the controversial Kaliwa Dam project.

The Kaliwa Dam project is being eyed as a solution to the recurring problems in water supply in Metro Manila that has been triggered by the persistent El Niño.

Carrying empty pails and water gallons, the Dumagats, led by Marcelino Tena, call on the government to stop the project as it would affect thousands of lives and would destroy the serenity of the Sierra Madre mountain range.

Debt watchdog warns against signing Kaliwa Dam loan

The Freedom from Debt Coalition (FDC) warned the Duterte administration not to push through with plans to sign the bilateral loan agreement to fund the controversial Kaliwa Dam project during the coming visit of Chinese president Xi Jinping.

‘It is fairly obvious that proponents of the Kaliwa dam see Xi Jinping’s visit as an excuse to railroad the project so it can be added to the list of agreements that the Chinese eader will be signing with Pres. Duterte. We fear that in the rush to get the project signed, the legitimate concerns of key stakeholders including indigenous peoples, LGUs and local communities are being ignored,“ FDC president Rene Ofreneo said.

The FDC warned against the proposed loan agreement itself citing attached conditionalities and “patently unfavorable“ terms.

“Apart from the obvious fact that the loan will add to the country’s P7.043 trillon debt, we are concerned about the specific loan terms and conditions. Even though the loan agreement has yet to be signed for example, the Chinese have already demanded, and the Duterte government has agreed, to limit project bidders to Chinese firms only. This type of “tied aid“ often ends up benefiting the creditor country more than the country going into debt.“

“Even more worrisome, if we go by some of the Chinese loan contracts already signed such as the Chico River Pump Irrigation Project, the loan terms are significantly less favorable at 2% interest with a maturity of 20 years than, for example, a comparable loan from Japan which has interests rates ranging from 0.25% to 0.75%. At a time when our debt is ballooning due to factors such as the depreciating peso, doesn’t it make sense to exercise more fiscal responsibility by going for the most favorable loan terms available? The current General Approprations Act actually contains a provision for an audit of 20 loans that FDC identified as illegitimate. Let us not add another one to that list,“Ofreneo said.

P12.2-billion Kaliwa Dam project is designed as a dam with a 600 million-liter per day (MLD) capacity, as well as a raw water conveyance tunnel with a 2,400 MLD capacity, aimed at relieving Metro Manila’s dependence on the aging Angat dam..

‘The Kaliwa Dam, one of several dams proposed within the Sierra Madre area has long been opposed by the people because of its potential environmental, social and economic impacts. For one, the dam will be built within one of the country’s key biodiversity areas, the Sierra Madre, where preparatory activities for the dam’s construction has already caused damage including the destruction of several hundred trees. Further damage to both flora and fauna is expected once the project begins in earnest. The project needs to secure an Environmental Compliance Certificate, which has yet to be issued,“ Ofreneo added.

“In addition, the project falls within the ancestral domain of indigenous groups, particularly the Dumagat-Remontados, for which the proponent, the MWSS, needs to secure Free Prior and Informed Consent (FPIC) as mandated by Indigenous Peoples Rights Act or RA 8173. As far as we know, this key step has not been complied with yet,“Ofreneo said.
