… at pasimulan ang CBA nego – Ito ang aming GUSTO! Now na!!

Pebrero 2013, wala pang isang taon matapos mabili ng PLDT ang Digitel, ini anunsyo ng PLDT ang pagsasara ng Digitel upang isanib ang operasyon nito sa PLDT! Ang mga empleyado ng Digitel ay pinag a avail ng Voluntary Retirement Program (VRP) Early Retirement Program (ERP) bilang kondisyon para mabayaran ng 190-250% separation pay at may prayoridad daw na ma “re-hire”. Ang di mag a avail ay i- re redundant at ang bayad sa separation pay na ayon na lang sa isinasaad ng batas.

Pagsasara at pagtatanggal upang palitan ang mga regular na manggagawa ng kontraktwal, mula sa dating tuwirang empleyado ay itatalaga at o mula sa outsourcing o manpower agencies. Labag ito sa karapatan ng mga manggagawa na ginagarantiyahan ng batas . Labag din ito sa DESISYON/ RESOLUSYON ng Korte Suprema . Salungat din ito maging sa batas ng korporasyon , na nagsasabing mananagutan sa mga empleyado ng biniling kumpanya ang bumiling kompanya.

Trabaho hindi bayad o mag VRP/ERP. Bakit ba kailangan pang mag VRP/ERP bago i re-hire ng PLDT? Bakit tatanggalin ang mga manggagawang gusto pang manatili sa trabaho para palitan ng mga (dating) manggagagawa ng outsourcing company.

Mga kaganapan bago ang pagbili ng PLDT sa Digitel.

Bago ang pagbili ng PLDT sa Digitel – sunod sunod ang pagkatalo ng Digitel manedsment sa mga kasong isinampa ng Digitel Employees Union (DEU) sa DOLE, NLRC, Court of Appeal hanggang Supreme Court. Sa ganitong kondisyon umentra ang PLDT para “bilihin” ang Digitel kapalit ng 12% shareholding sa PLDT Holding pabor sa DJ Summit Holdings na siya ring may-ari ng Digitel na pag-aari din ni John Gokongwei.

Matapos ang “bilihan” / shareholdings swapping, hindi nagpatumpik tumpik ang PLDT – ipinagpatuloy nito ang Voluntary Resignation Program (VRP) /Early Retirement Program (ERP) na napasimulan na ng Digitel. Nauna dito ang serye ng Mass Lay off – una ay noong Marso 2005, sinundan noong taong 2007, 2008 upang makaiwas daw sa pagkalugi. Mass Lay off naman noong 2010, dahil umano sa restructuring program ng Digitel. Hanggang maganap ang “bentahan” noong taong 2011, ang kakatwa walang taon sa panahong nagtanggal na nalugi ang Digitel. Samantala matapos “ibenta” / sharewap ay nakakuha ng P1Billion na dibedendo sa PLDT si Gokongwei na may ari ng Digitel noong huling kwarto ng taong 2012 na di pa nangyari sa kasaysayan ng Digitel.

Oktubre 8, 2012, sa wakas bumaba na ang DESISYON ng Supreme Court – inayunan nito ang mga naunang DESISYON ng DOLE Secretary, NLRC at Court of Appeal na nagsasabing;

1. For Digitel to Commence CBA negotiation with the union. The pendency of a petition for cancellation of union registration does not preclude collective bargaining.
2. Affected workers be reinstated and with full pay full back wages for –
Digiserv is a labor-only contractor and or just one department of Digitel thus; affected workers due to its closure were illegally dismissed,
3. Pay each affected employees P10,000 moral damages and P5,000 exemplary damages for finding DIGITEL guilty of Unfair Labor Practice for – closure of Digiserve and replace it with I-tech andl dismissal of affected employees mostly union members and officers is illegal and done in bad faith; also violation of the Assumption Jurisdiction Order, .

Sa halip na ipatupad ang DESISYON – na makipagnegosasyon sa unyon at ibalik ang mga apektado/tinanggal na empleyado, tuwirang sinalungat ng Digitel/PLDT ang Kautusan ng Korte Suprema at Writ of Execution ng DOLE Secretary. Ikinatwiran ng Digitel/PLDT wala ng dahilan para makipagnegosasyon pa siya dahil wala ng manggagagawa ang DIGITEL.

Paninindigan ng mga manggagawa ng Digitel – una; i absorb ng PLDT ang mga empleyado ng Digitel at pasimulan na ang CBA negotiation. ikalawa; kung ini-integrate ang operayon ng Digitel sa PLDT, dapat I absorb ang mga empleyado, pangatlo; gusto pa nilang patuloy na magtrabaho at hindi sila nag avail ng ERP/Redundancy, pang-apat; hindi naman totoong nawala ang trabaho na ginagampanan ng mga tinatanggal bagkus pinalitan lamang sila ng kontraktwal.

Pagsusuri ng DEU; Voluntary o Early Retirement, Clossure at integration ng operation- maniobra at palusot para iwasan ang DESISYON ng Korte – kasi po kapag kusang nagresign o nag avail ng early retirement … tapos na ang kwento ng mga nagawang paglabag sa batas o pagyurak sa karapatan ng mga manggagawa (ULP). Ang closure integration naman ay iskema para lusawin ang Unyon at palitan ng kontraktwal ang mga regular na empleyado ng Digitel.

Ang pinakahuli ay ang lantarang pagsuway sa DESISYON at KAUTUSAN ng Korte Suprema at Writ of Execution na ipinag uutos ng Secretary of Labor.

Batid naming mabigat ang labang ito sa dalawang dambuhalang kompanya – DIGITEL at PLDT ! Kung kaya kami po ay umaapela sa kapwa namin kamanggagawa at sa mamamayan na kami ay inyong tulungan at samahan sa labang ito.

Retire/Resign – REHIRE, No Way!!!

After shaving their heads, members of the Digitel Employees Union (DEU) set up a protest center in front of the DOLE Office. The protest of the Digitel Workers will continue until the DOLE Secretary releases a Motion for Execution for the Supreme Court Decision last January 21, 2013 stating that DIGITEL (now under the PLDT Group) is guilty of unfair labor practice and telling the Digitel Management to reinstate all dismissed workers.

Last March 19, 2013, they filed a letter of Appeal in Malacanang for PNoy to look into their plight.

DIGITEL Employees Shave Heads in Protest, Motion for Execution Pushed

kpd logoManila—Shaving their heads to underline their protest, Digitel employees picketed in front of the Department of Labor and Employment Office this morning, demanding that Labor Secretary Rosalinda Baldoz immediately issue a Motion for Execution of the Supreme Court Decision last January 21,2013 ruling that DIGITEL (now under the PLDT Group) is guilty of unfair labor practice, that the earlier dismissed workers must be reinstated and that management immediately commence collective bargaining proceedings with the certified bargaining agent, Digitel Employees Union or DEU.

CLOSURE

“ We won in all cases… but now it will come to nothing if the DOLE Secretary and Court can’t prevent DIGITEL/PLDT merger from closing down DIGITEL and integrate its operation to PLDT as pretext to redundancy,” explained Allan Licardo, DEU President.

“Anong halaga ng DESISYON kung wala na ang mga EMPLEYADO. Hindi lang ang Digitel/PLDT ang may kasalanan at maaring sisihin, ang pagsasawalang kibo ng opisina ng DOLE ay may malaking parte din dito,” added Licardo.

All the surviving Digitel employees/DEU members will be dismissed under closure/integration cum redundancy program of Digitel/PLDT.

He added that in four instances DOLE came down with an Assumption of Jurisdiction (AJ) order every time they were poised to strike, in reaction to the mass lay off/dismissal by Digitel management and the continued refusal to start collective bargaining negotiations.

“ We went along with all the legal procedures until our case reached Supreme Court and got a favourable decision but in the midst of this our membership was continuously under attack by outsourcing, harassment and mass lay-off perpetuated by management,” lamented Licardo. DEU members are now only around 100 from almost 1,000 in 2005.

‘Palusot’

Pete Pinlac-MAKABAYAN Chairperson said that the present closure – integration of Digitel operation to PLDT cum redundancy is really a scheme to get rid of the union and the regular employees to replace them with contractual workers. “ Palusot lang ito ng management para hindi na kailangang ipatupad ang desisyon ng korte,” pointed out Pinlac

Licardo appealed to President Aquino to look into the plight of Digitel Workers.

26 workers dismissed, harassed after nixing management union

Dear friends and partners,

The Center for Trade Union and Human Rights together with the workers of Bacolod Columbia Markerting Inc.(BCMI), is appealing to you to support the fight of the workers of BCMI against unjust dismissal, unfair labor practice and non-recognition of their union.

On two separate instances last September, at least 26 workers of the BCMI. have been unjustly removed from work after they successfully replaced the management-appointed union leaders through a local election. On October 4, the workers under the new leadership of BCMI Workers Association filed a notice of strike against BCMI management on grounds of unfair labor practice and union busting.

Case Summary:

Twenty-six workers of the Bacolod Columbia Marketing Inc. Workers Association (BCMWA), were unjustly dismissed in two separate instances in September 2012. Dismissed workers include the newly-elected officers of the BCMWA following a local election that deposed management-installed union leaders. The workers were:

BCMWA was first organized by Congress of Independent Organization-Associated Labor Union (CIO-ALU) in August 26, 1991 without the knowledge of rank and files employees. The union officers, coming largely from the supervisory ranks, were handpicked by the management who voluntarily recognized the union in 1996. Again in 2001, BCMI General Manager (GM) Alfonso Choa voluntarily recognized the union.

Starting 2001, the management through Mr. Choa and the CIO-ALU have secretly concluded 3 collective bargaining agreements (CBAs). But it was only in the first quarter of 2011 when the workers knew that there was a union. The workers also learned about the “substandard” CBA of 2011-2016 forged between the management of Mr. Choa and CIO-ALU.

In response to this management deceit and treacherous attack on workers’ rights, the workers of BCM organized themselves to establish a workers union that will truly uphold their interests. On September 10, rank and file workers conducted a local election which deposed the management-picked union leaders and installed a new set of officers: Crusos Tanaman as President; Jose Judy Buen as Vice President; Janeth Lim as Secretary, Eduardo Descutido as Treasurer; Roberto Amante as Auditor while Donah Singson; and Jose Ronald Canenaje, Jonie Dela Pena, Remos Torrecarion, Jomar Reusora and Danilo Gacutin as Board of Directors.

This move however earned the ire of the management. In several instances, leaders and members of the new union were harassed, intimidated and discriminated by the BCMI management and its security forces:

1) On August 13, 2012 at about 10:20 in the morning, BCMI workers Crusos Tanaman and Jomar Reusora were held at gunpoint (using an M-16 rifle and a .45 caliber pistol) in front of 14 other workers by BCMI security guards Fernando Alolor and Alexander Alison together with Choa’s personal bodyguard Gabriel Hinolan while the two workers were piling consumer products on their delivery truck.

Tanaman, Reusora and the 14 others immediately reported the incident to the nearby Police Station and filed a complaint at the village council in Bgy. Villamonte. Then they resumed working and extended their duty to complete their 8 hours of work on that day.

2) On August 20, Choa suspended Tanaman, Reusora and 15 others for allegedly abandoning their work on August 13.

3) On Septmber 18, Choa and his lawyer sent a letter to CIO-ALU stating that the “persons who participated in the union election and who were voted into as officers were already-duly discharged from their duties.” Choa also notified CIO-ALU that the elected officers were already terminated amidst the pending suspension and in the absence of their termination notices. Choa in discriminating the new officers told CIO-ALU that the management “will be assisting CIO in determining the actual employees of the Company who were qualified to vote.”

4) On September 19, Tanaman and the 15 other workers reported to work after their 30-day suspension. Security guards however barred them from entering company premises.

5) On last September 24, Mr. Choa sent a letter to CIO-ALU dismissing Tanaman and the 15 others from their work. Another batch of suspensions and dismissal were imposed upon 10 more workers on various grounds and charges.

The workers tried to settle their complaint with the management through a grievance procedure. However, Choa continue to refuse to recognize Tanaman as the duly-elected union president mandated to represent the workers.

On October 4, 2012, BCMWA filed a Notice of Strike at National Conciliation and Mediation Board on grounds of unfair labor practice and union busting.

Bacolod Columbia Marketing, Inc. or BCMI is primarily engaged in Marketing and Distribution of major fast moving consumer products around Negros Island especially in popular Department Stores and Malls.

Congress of Independent Organization-Associated Labor Union (CIO-ALU) is a confederation of labor union affiliated to the Trade Union Congress of the Philippines.

Action Needed:

Please write to the authorities asking their intervention in order to prompt BCMI management to:

1) Immediately reinstate the 26 unjustly dismissed employees!

2) Stop unfair labor practice and union busting against the members of BCMWA!

3) Respect workers’ freedom of association!

Subic, Zambales– “We condemn Hanjin’s lack of compliance to health and safety standards”, this is the statement of SAMAHAN (Samahan ng Manggagawa sa Hanjin Shipyard) in response to the death of another worker and a SAMAHAN member Alvin Dalunag.

Alvin Danulag 31 year-old, a native of Kalinga province is a grinder at the panel part welding shop unit 45-1 project 62-658 under the subcontractor Redondo I Tech fell off a block about six feet high yesterday at around 9:00 am. His head hit into several stiffeners and metal frames, he was found faintly breathing by fellow workers and immediately rushed to the St. Lourdes hospital. At about 3:00 p.m. he died at the hospital.

Alfie Alipio, SAMAHAN president added that Dalunag’s death concretely shows how risky the shipyard has become for most workers considering its lack of compliance to Occupational Health and Safety standards.

According to Manggagawa para sa Kalayaan ng Bayan (MAKABAYAN) accidents are still frequent at HANJIN shipyard.

In a span of a week from March 08, to March 14, 2011 alone they have documented at least 5 cases, and from April 08 up to April 11 they have monitored 3 cases of accidents involving at least 5 workers. This excludes the cases of skin disease and eye swelling due to metal fluxes.

“It is painful to think that Hanjin management is denying and distorting the workers’ cause of death instead of taking responsibility.” Alipio lamented referring to management’s statement that the worker (Dalunag) died merely died of cardiac arrest.

It can be recalled that the string of accidents in 2008 prompted Hanjin workers to form a union but until today the union registration is not yet released despite of a favorable decision from the office of the National DOLE BLR.

SAMAHAN and its entire membership appeal to concerned agencies and the P.Noy administration to protect the lives of its Filipino workers by making Hanjin fully compliant to occupational health and safety standards as well as the Philippine labor code.
