Human rights defenders push for the adoption of human rights framework in the Bangsamoro Basic Law

(Cotabato City) In the observance of the International Human Rights Day, Bawgbug is spearheading a series of community based consultations in Basilan, Sulu and Tawi-Tawi for the drafting of a Bangsamoro Basic Law with a strong and highly defined human rights framework. “This is one of the shortcomings of the 1996 Final Peace Agreement which failed to entrench human rights principles and mechanisms into the governance structure of the ARMM. That is why the worst forms of human rights violations are committed in the Bangsamoro areas and the culture of silence and impunity persists”, Cocoy Tulawie, human rights defender from Sulu, explained.

Participating in the widespread consultations will be the vulnerable and marginalized groups from the poorest of the poor in the island provinces. Using open space dialogues, Bawgbug will consult the survivors of massacres, families of desaparecidos, victims of kidnappings, indiscriminate bombings and shellings, the survivors of the gang rapes of powerful political clans in Sulu, youth and religious leaders who are oftentimes victims of illegal arrests and arbitrary detentions. It will also consult the diaspora in Zamboanga and Sabah who were forcibly driven out of the Basilan, Sulu and Tawi-tawi because of the long drawn armed conflict that hardly observe international humanitarian law.

According to Rose Trajano Secretary General of the Philippine Alliance of Human Rights Advocates, “All begins with human dignity. The Bangsamoro Basic Law should be designed to ensure that a person’s dignity is protected and guaranteed”.

Law should not deprive a human being of life, liberty, property & dignity. Thus any basic law must have intrinsically a human rights framework, Warina Jukuy, Convenor of Hijaab Niqaab Advocacy Network, said.

Bawgbug, which in Tausug means to ‘stand and protect’ aims to put an end to a destructive and violent culture that is very apparent in the Bangsamoro region; a norm that propagates an apathetic orientation towards a human being’s dignity. This societal plague has been the cause of systemic injustice which called for many Moros to take up arms to protect their own families and communities. “Hopefully, with the signing of a Comprehensive Peace Agreement between the Philippine Government and the Moro Islamic Liberation Front, the status quo which they have described as unacceptable will indeed be changed. The challenge for the Moros will be how to bring in meaningful changes in the lives of ordinary people; how to set up a government that will be protective, responsible and accountable to human rights. The challenge now is how we can introduce new politics into this new political entity for the Bangsamoro”, Cocoy Tulawie said.

Cocoy Tulawie is currently detained at the Davao City Jail due to malicious and fabricated charges against him by the Governor of Sulu. International human rights organizations from all over the world are rallying behind Cocoy Tulawie describing his situation as a classic example of criminalization of human rights defender in order to silence and cripple his human rights work.

BAWGBUG commits to conduct at least 15 community-based and sectoral consultations order to enflesh concrete proposals and recommendations on relevant human rights provisions for the Bangsamoro Basic Law. Results of the consultations will be submitted to the Bangsamoro Transition Commission before end of January 2014. (Mashod Salic, December 21, 2013).

COTABATO CITY (MindaNews/20 May) – OIC Governor Mujiv Hataman of the Autonomous Region in Muslim Mindanao (ARMM), recently proclaimed winner in the ARMM gubernatorial race, has vowed to lower the double-digit poverty incidence in the country’s poorest region, to “single-digit during our term.”

Among 17 regions nationwide, the five-province, two-city ARMM is the country’s poorest, posting 46.9% according to the National Statistical Coordination Board’s “First Semester Per Capita Threshold and Poverty incidence Among Families, by region and provinces, 2006, 2009 and 2012” released on April 23 this year.

ARMM comprises Lanao del Sur and Maguindanao in the mainland, the island provinces of Basilan, Sulu, Tawi-tawi and the cities of Marawi and Lamitan.

Nationwide, the NSCB said, “22 out of 100 families were estimated to be poor in the first semester of 2012 with the average poverty incidence at 22.3%. In the ARMM, the figure is more than twice at 46.9% or 47 out of 100 families.

In Lanao del Sur, the figure is thrice the national average at 68.9% and Maguindanao at 57.8%. Basilan’s poverty incidence is at 32.5%, Sulu’s is 30.4% while Tawi-tawi’s is 20.8%.

According to the National Citizens’ Movement for Free Elections (Namfrel), candidates are offering up to P3,500 for a single vote in Ilocos Norte, P3,000 in neighboring Ilocos Sur, P2,000 in Zamboanga Sibugay, and P100 in Tawi-Tawi.

In a letter sent to the Commission on Elections (Comelec) on Thursday, Namfrel chair Corazon de la Paz-Bernardo said reports from the group’s volunteers showed that vote-buying—either with cash, groceries, and even farm implements—is expected to intensify as Election Day nears, with some candidates even resorting to “bidding” to corner votes.

Comelec Chair Sixto Brillantes Jr.’s advice to voters: Take the money and junk the candidates.

“Take it but junk those who give you money. That’s the only way to do it so that the next time these people will not give away money because they know they will lose,” Brillantes said in an interview on Friday.
The Comelec tried to fight vote-buying by prohibiting bank withdrawals in excess of P100,000 and carrying cash worth more than P500,000, but President Benigno Aquino III rejected the strategy on Thursday, saying it was bad for the economy, and the Supreme Court, acting on a petition brought by bankers, stopped it on Friday and called for oral arguments.

Brillantes said vote-buying had become more rampant because politicians had fewer means to “manipulate” the vote after the automation of elections in 2010.

Civil society urges Malaysia to be consistent as a peace broker; calls for dialogue on Sabah crisis

Mindanao PeaceWeaverThe Sabah crisis may be hogging the headlines now, but the Mindanao PeaceWeavers (MPW) hopes that the raw passions generated by the politicization of the issue will not derail the collective gains we continue to harvest from the GPH-MILF peace process that is about to wind up.

Indeed we cannot totally insulate the GPH-MILF peace talks from issues that have implications on the ties between the Philippines and Malaysia who is the facilitator of the process. Thus MPW believes that Malaysia must reiterate their commitment to peace by ending the violence in Sabah. Malaysia should enter into dialogue among parties involved to peacefully resolve the dispute the same way that it has sought to do with the GPH and the MILF.

MPW also calls on the Philippine government to pursue the peace process resolutely while it fulfills its obligation in protecting the legitimate and human rights of its citizens affected by the violence in Sabah and the needs of the refugees in Tawi-Tawi and Sulu.

MPW also appeals to the Sultan of Sulu and his followers to maintain their earlier declaration of a unilateral ceasefire and exert all means to resolve the issue peacefully and honorably. We urge them to be mindful of provocateurs that may use their legitimate concerns with other selfish agenda. The Sultanate has made their point.

Once again, we reiterate our message to the governments of Malaysia and the Philippines and the Sultanate of Sulu to: IMPLEMENT A “HUMANITARIAN CEASEFIRE” IN THE CONFLICT-AFFECTED DISTRICTS IN SABAH.

1. CEASE & DESIST MILITARY ACTION & ATTACKS of Malaysian police, army and the followers of Sultan Kiram III by declaring a bilateral ceasefire and cessation of hostilities until the humanitarian crisis is fully addressed.

2. A PUBLIC CALL FOR HUMANITARIAN ACTION to adequately address the humanitarian crisis in Lahad Datu, Sabah and Tawi-Tawi, Sulu.

3. ADDRESS the forced evacuation and deportation of Filipinos and provide immediate consular assistance.

4. ALLOW & PROVIDE SAFFE PASSAGE of independent local and international humanitarian groups to help conduct humanitarian action and monitor the situation

5. NEGOTIATE a consensus on the mechanics of “disengagement” of all armed actors in the conflict areas.

6. URGE for the governments and the followers of Sultan Kiram III to discuss key issues on the table and exhaust dialogical means in conflict resolution.

7. AGREE & IDENTIFY an external dialogue facilitator (specifically from among the ASEAN member-states) in bridging the process.

8. DENOUNCE the reported increasing human rights violations caused by the OPS Daulat of the Malaysian Government in their mopping up operation against Kiram’s followers

9. ENCOURAGE independent and civil society-led fact-finding missions to study and investigate on the status of the human rights situation in the districts of Sabah

10. CALL for a convergence of local and international/regional actors to assist and monitor the refugee situation in the Sulu Islands and the borders of Sabah. Urge for an interagency action from ASEAN existing mechanisms, UNHCR, OCHA, IOM, etc., to facilitate.

With utmost humility, we also request both the GPH and MILF to release a joint statement on the Sabah issue the soonest – not only to serve as an assurance that the peace talks is moving, but also an affirmation believing that the power of dialogue will deliver the promise of humanity in the districts of Sabah and Tawi-Tawi, Sulu.

ZAMBOANGA CITY (MindaNews/30 August) – The Women and Children Protection Desk (WCPD) of the Zamboanga City Police Office (ZCPO) has rescued 18 victims, including six minors, of human trafficking at a private wharf in this city, a police official revealed Thursday.

Senior Insp. Gemma Luna, WCPD chief, disclosed that the victims were rescued around 9 a.m. Wednesday while they were about to board a ferry bound for the province of Tawi-tawi at a private wharf in Barangay Baliwasan, this city.

Luna said the rescue of the victims came after operatives from her office, in coordination with the Sea-Based Anti-Trafficking Task Force (SBATTF), responded to a report that human trafficking victims were sighted at Baliwasan seaside.

The rescued victims told the police that they were hired to work as fishermen in Tandubas municipality, Tawi-tawi.

Luna said the victims identified their recruiter as Melzar Ujatimuay Danda, of Kabasalan town in Zamboanga Sibugay, and their employer as Magellan Mohammad Ali-Naugan.

The rescued victims were turned over to the Visayan Forum Foundation (VFF), a non-government organization (NGO) which works on issues of domestic work, child labor and human trafficking, especially of women and children, Luna said.
