Diokno: Even social media posts could be considered terrorism under anti-terror law

Human rights lawyer Chel Diokno on Tuesday told the Supreme Court that even Filipinos who exercise their basic rights on social media may be considered as committing terrorism crimes under the assailed Anti-Terrorism Act of 2020.

Diokno, one of a handful of lawyers representing 37 sets of petitioners in oral arguments, said the law is worded in a way that gives law enforcers the power to infer the “intent” behind protests, work stoppages, and other exercises of civil and political rights.

The law exempts these activities from the definition of terrorism, but only as long as they are “not intended to cause death or serious physical harm to a person, to endanger a person’s life, or to create a serious risk to public safety.”

Diokno said this places the petitioners, many of whom are activists, at the risk of being arrested and prosecuted based on the “subjective impression” of law enforcers of what their intent was.

He claimed that ordinary citizens exercising their basic rights are also in peril.

[In the news] Probe set for QC inmate’s possible coronavirus-related death -GMAnews

The Quezon City Health Department has started an investigation into the death of a male inmate at the Quezon City Jail, who may have been infected with the virus that causes coronavirus disease (COVID-19), according to Saleema Refran’s 24 Oras report on Friday.

The death certificate of the inmate states that the immediate cause of death was acute myocardial infarction or heart attack.

However, listed as other significant conditions contributing to death is that the inmate may be a possible COVID-19 patient for two weeks.

The city health department said the inmate exhibited some flu-like symptoms.

“(The inmate was) complaining of parang difficulty of breathing. Dead-on-arrival yata siya ma’am. I’m sure hindi po siya na-test siguro,” Feliza Luna, a Quezon City Health Medical Officer, said.

Bureau of Jail Management and Penology spokesman Xaiver Solda said, “Nakita naman natin talaga ‘yung primary cause of death niya, no? May nakasulat doon na possible COVID-19 case.”

“Kung talagang positibo ‘yan siya at meron sapat na basihan ‘yung doctor, talagang sasabihin niya d’yan diretsya na this is a COVID-19 case. Pero hindi,” he added.

[In the news] Sitio San Roque residents finally get aid, believe it’s because of their protest -GMAnews

Residents of Sitio San Roque in Quezon City finally received on Thursday the long-awaited food packs from local authorities.

Officials of Barangay Bagong Pag-asa and some City Hall staff led the distribution of aid to residents, according to a 24 Oras report by Ian Cruz.

“Ngayon lang po, kung hindi kami nag-rally kahapon sa labas, hindi kami nabigyan ng pansin,” said Clara Vargas, a San Roque resident.

She joined her community in protesting along EDSA on Wednesday over aid promised by the local government that they had yet to receive.

[Action Alert] A barangay chieftain allegedly hit a violator of the Enhanced Quarantine with a bamboo stick -PAHRA

In the current crisis we are facing, the greater the authority of government officials, the greater the possibility for them to abuse their power in dispensing public services to the people.

In this video posted by GMA News dated March 27, 2020, a barangay chieftain allegedly hit a resident with a bamboo stick when the latter and his wife were seen washing clothes outside their house. The authorities apparently argued that the person violated the enhanced community quarantine policy of the government during the Luzon total lockdown to fight the spread of the coronavirus.

Eventually, the incident has been resolved between the victim Marvin Alcorroque and Barangay Chairperson Benjie Hernandez of South Daang Hari in Taguig City. But during the interview done by 24 oras news reporter with the couple, Jane La Villa the wife of the victim said that Hernadez is to blame if something bad happens to his husband.

This barangay personnel must be made accountable and immediately sanctioned. They should be charged with administrative and, criminal charges—if warranted.

Abusive officials tasked to implement the policy will only discourage public cooperation. Public officials are not only limited to enforcing the law but also and more importantly to serve and protect the public’s interest and wellbeing.

Public officials should always be reminded to remain within the limit of the law, assuring accountability, participation, and as well as providing legal remedies for citizens whose rights and interests have been violated.

We encourage the public to continuously report such abuses.

Human rights group Karapatan has denounced the alleged “raid” that were conducted in the offices of some groups in Bacolod City on Thursday afternoon.

In a statement, Karapatan claimed that authorities had used a search warrant to target the offices of Gabriela, Bayan Muna as well as the National Federation of Sugar Workers in the area.

“The use of search warrants has become a trend increasingly used in Negros, which makes offices and individuals vulnerable to the planting of evidence,” Karapatan said.

Information from Police Regional Office 6 said four search warrants issued by Executive Judge Cecilyn Burgos-Villavert of the Branch 89 of Quezon City Regional Trial Court were implemented on alleged communists’ safehouses in Bacolod City.

The Commission on Human Rights (CHR) expressed concern over alleged faked consultation and approval from affected indigenous communities to push through the construction of Kaliwa Dam in Quezon

CHR spokesperson Jacqueline Ann de Guia said the free prior and informed consent (FPIC) is necessary to activities that affect indigenous peoples’ (IPs) ancestral lands, territories and natural resources under IPs’ right to self-determination.

“The right to free consent implies equally the right to dissent,” De Guia said in a statement on Monday.

“If indigenous peoples are clearly opposed to a particular project, their decision should be respected and they should continue to benefit in the same way as other people from State benefits, development plans and services,” she added.

A CCTV footage used in the movie showed a tricycle driver waiting for a passenger in Caloocan City with his toddler kid inside the vehicle. Moments later, in broad daylight, he was shot dead by an unidentified gunman in a motorcycle.

Scenes showing police operations in communities — knocking on houses, interrogations, arrests, buy-bust, and the like — were shot based on testimonies of victims and their families, who have actually experienced the brunt of President Rodrigo Duterte’s war on drugs.

Sandigan to start forwarding records of Imelda Marcos’ graft case to SC

The Sandiganbayan has started the process of forwarding records in the graft case of Ilocos Norte Representative Imelda Marcos to the Supreme Court, where she will challenge her conviction for allegedly creating Swiss foundations to benefit her family.

The Fifth Division confirmed on Tuesday that Marcos’ notice of appeal has been “given due course.”

It said the records are being photocopied for the Sandiganbayan archives, but the original copies will be immediately transmitted to the SC upon completion.

This development comes after the Sandiganbayan granted the motion of Marcos to avail of post-conviction remedies, allowing the 89-year-old widow of former President Ferdinand Marcos to either appeal her conviction at the anti-graft court or raise her case to the SC.
