PNoy approves six-month extension of deadline for Martial Law claims application

Three months after the November 10, 2014 deadline expiration, President Benigno “Noynoy” Aquino III has approved Joint Resolution No. 3 extending for six months the deadline for Martial Law claims application to May 2015.

Joint Resolution No. 3 is the consolidation of Senate Joint Resolution No. 10 and House Joint Resolution No. 16.

“The enactment of the law is a crucial victory for the families and victims of human rights violations during the Martial Law period whose hope and opportunity to file their claims for reparation and redress for the sacrifices and sufferings they endured in the past were blighted by the November 2014 deadline,” Akbayan Rep. Barry Gutierrez.

“With the new deadline, we ensure that all legitimate claimants, particularly those who are now in their final years and those who are living in the far-flung areas, are given the vital time and full opportunity to file their claims with the Human Rights Victims’ Claims Board,” the lawmaker added.

Gutierrez said that an estimated 25,000 to 50,000 legitimate claimants are yet to file their claims for reparation under Republic Act No. 10368, or the Human Rights Victims Reparation and Recognition Act of 2013.

“Even as a new deadline is set, we, however, continue to urge the various grassroots-based civil society organizations located across the country to support the Board in reaching out to all the victims, many of whom have no access to public information on Martial Law claims and the Claims board,” the Akbayan solon said.

“Through our collective efforts, we could help usher in the much-needed redress to the victims and provide a proper recognition of their heroism and sacrifices in defense of individual rights and liberties and the nation’s democracy while laying down the necessary steps toward national healing and renewal,” he concluded.

The Philippine Alliance of Human Rights Advocates (PAHRA), a coalition of human rights groups, is urging Pres. Noynoy Aquino to immediately act and certify as urgent a Joint Resolution for the extension of filing of Martial Law victims’ claim.

?Max de Mesa, PAHRA Chairperson, noted that the deadline for the filing of claims on November 10, 2014 is fast approaching but many human rights victims have yet to file their claims before the Human Rights Victims Claims Board (HRVCB).

“PNoy’s action by certifying urgent the resolution for extension in filing claims will give hope to many human rights victims by giving more time for them to prepare and complete their claims and for the HRVCB to complete its mandate,” PAHRA Secretary General, Rose Trajano, said.

“There are, in fact, more than 7,000 undocumented human rights victims from the cursory research conducted by our group, apart from the more than 9,000 Hawaii class suit claimants. As of October 2014, HRVCB has received only around 29,000 claims, lower than the 55,000 to 90,000 applications expected by the Board officials. It is evident that much more work has to be done if we are going to provide compensation and give some measure of justice to all deserving claimants.” De Mesa explained.

An active search and assistance by PAHRA members and network of civil society organizations and human rights defenders’ organizations are supplementing the best efforts of the Board in reaching out to communities all over the country.

“The extension, more than the filing of claim, ensure that all human rights victims will be given access to a means of gaining redress for the sufferings and sacrifices that they endured during the Martial Law,” De Mesa continued.

PAHRA stressed that both the HRVCB and the Commission on Human Rights have also seen the urgent need to extend the period for filing of claims under the said law, because of the huge numbers of applicants coming in to the Board’s main office in Quezon City as well as at its scheduled mobile intakes in the regions and provinces, is posing a big challenge to the existing and available resources of the Board, given the time allowed by the law which shall end on November 10, 2014. Under RA 10368, “(t)hat ‘failure to application within said period is deemed a waiver of the right to file the same.”

The House of Representatives passed on Second Reading House Joint Resolution No. 16 filed by Akbayan Representatives Barry Gutierrez and Walden Bello and is set to pass the same on Third Reading next week. While the Senate is expected to pass Senate Joint Resolution No. 10 filed by Sen. Francis “Chiz” Escudero next week.

Akbayan Rep. Gutierrez pushes for extension of deadline for filing of claims for Martial Law victims

“The lack of time should not pose as a hindrance to the recognition and reparation of the human rights victims for the sufferings and sacrifices they endured during Martial Law,” Akbayan Rep. Barry Gutierrez said.

His statement came Sunday on the 42nd year commemoration of the imposition of Martial Law on September 21, 1972, saying that “recognizing the struggles of the victims is important more than ever, as most survivors enter their final years.”

Gutierrez filed Joint House Resolution No. 16 extending the deadline for filing of claims for victims of human rights during the Marcos regime to cope with the large number of persons seeking for reparation and recognition under Republic Act 10368, or the Human Rights Victims
Reparation and Recognition Act of 2013.

From November 10, 2014, the proposed measure seeks to move the deadline application to May 2015.

“The six-month extension was sought to allow the legitimate claimants, especially those living in far-flung areas of the country, full opportunity to file their claims with the Human Rights Victims Claims Board (HRVCB) and gain redress for injustices they suffered four decades ago,” Gutierrez said.

Emphasizing the urgency of the resolution, Gutierrez urged Congress for the immediate approval of the proposed measure, saying this is
important in “making certain that the struggles of the people who have fought the Marcos dictatorship are given due recognition and the full
opportunity to secure their rightful place in our history.”

“[And] we need to ensure that all those who suffered in the defense of freedom and democracy are rendered full justice,” he added.

“We urge both Houses of Congress to swiftly and immediately approve this measure that ensure the full realization of the goals and objectives of RA 10368 to recognize and provide reparation to the victims and their families who suffered deaths and unspeakable losses during one of the darkest periods in our history,” Gutierrez concluded.

President Benigno Aquino III will sign into law the Human Rights Victims Reparation and Recognition Act of 2013, which will officially recognize “the atrocities committed by the Marcos administration against their own people,” Malacañang said Saturday, February 23.

Some P10 billion funds recovered from Marcos’ Swiss bank accounts will be appropriated for victims’ reparation. Eighty percent of the amount will be spent for existing claims and 20% for future.

Dahil sa pinagbawal ni PNoy ang paggamit ng wangwang pinapayo ng mga bituin na gumawa ng mga signs ang MMDA upang swertihin sila.  Tulad ng “Bawal magwangwang, nakakamatay,” at “one wang.”  Iwanan na lamang ang isyu ng paninigarilyo at mga billboards, sasablay. Huwag magpakabihasa sa income generation, hindi niyo trabaho ‘yan.

Para kay Lacierda, payo ng mga bituin, iwasan ang pagiging spoiled brat upang hindi magmaktol si Midas Marquez.  Sige ka lagot ka pag umiyak ‘yan.

May nag-aabang na gantimpala sa pagsasakripisyo ni Iggy Arroyo para sa kapatid na si Mike Arroyo.  Sasalo ka ng swerte dahil sa palagiang pagsalo sa ibinibintang kay Mike Arroyo. Isa kang dakilang kapatid… Ano ba’t pasasaan at makakamtan mo din ang matagal nang hinahangad, ang makulong para sa mahal na kapatid.

Wala sa priority bills  ni PNoy ang compensation para sa mga biktima ng human rights violations ng Martial Law.  Payo ng mga bituin, mag-ingat sa mga sinasabi sa SONA na hindi kayang pangatawanan.

Upang maipasa ang nilalobby na batas laban sa sapilitang pangwawawala, pinapayuhan ng mga bituin ang mga human rights defenders na baguhin ang titulo nito. Gawin na itong “Batas laban sa sapilitang pangwawangwang.”

Gayundin ang pagtutulak na magkabatas para sa proteksiyon natin laban sa EJK. Baguhin ng kaunti ang titulo ng proposed bill, gawin itong anti-Extra WangWang Killings Act. Siguradong pasok ‘yan.

Ang Poleteismo ni Mideo Cruz ay tinuligsa, ang payo ng mga bituin ipagpatuloy lang niya ‘yan dahil effective siya. Ika nga ng mga bituin, You cannot please everybody but not everybody can make the Catholic Church react this way.  And not everybody belongs to the Catholic Church.

Payo ng mga bituin “Ang hindi lumingon sa pinanggalingan ay may stiffed neck” Pero ang payo ng mga bituin kay GMA, magpahinga ka na kasi, tama na sobra na.
